General Terms & Conditions
1. Introduction
Happy Hearts Nannying ("we," "us," or "our") operates as an introductory and administrative agency, connecting families ("Clients") with independent childcare providers ("Nannies"). By engaging our services, Clients agree to these Terms and Conditions.
2. Service Scope
We facilitate introductions between Clients and Nannies and, in the case of ongoing placements, provide administrative support services. Nannies operate as independent contractors, and Happy Hearts Nannying does not employ or supervise them directly.
3. Fees and Payment Responsibilities
Client-Nanny Payments: Clients are solely responsible for agreeing upon and paying the Nanny's hourly or weekly rate directly. Happy Hearts is not responsible for Nanny wages, superannuation, tax, or entitlements.
Ongoing Placement Admin Fee: Clients engaging a Nanny for ongoing care (e.g., regular weekly bookings) will be charged a weekly administration fee by Happy Hearts Nannying. This fee covers:
Ongoing support and communication with both families and Nannies as necessary
Maintenance of our vetted Nanny database
Management of a prescribed number of sick call replacements annually
Discounted casual bookings
Details of the current weekly admin fee and inclusions will be provided at the time of engagement.
4. Insurance and Liability
Nanny Insurance: Nannies introduced through Happy Hearts Nannying are independent contractors and are not covered by any insurance held by Happy Hearts. We strongly encourage families to verify that their chosen Nanny holds appropriate public liability or professional indemnity insurance.
Client Responsibility: Families should ensure they have suitable home and public liability insurance that covers domestic workers in their home, and car insurance if they will be driving your vehicle.
Limitation of Liability: We are not liable for the actions, conduct, or outcomes of Nanny care. Our role is limited to introducing, supporting, and managing logistics—not supervising care delivery. Our liability is limited to the extent permitted by law.
5. Client Obligations
Clients agree to:
Provide a safe, respectful, and lawful working environment for the Nanny
Communicate promptly and respectfully with both the Nanny and Happy Hearts
Fulfil payment obligations to both the Nanny and Happy Hearts in a timely manner
6. Nanny Obligations
Nannies are expected to:
Operate as independent professionals, managing their own tax, super, and insurance
Provide care in a manner that is safe, respectful, and aligned with the Happy Hearts values
Communicate openly and reliably with both the Client and Happy Hearts
7. Confidentiality
All parties agree to maintain the confidentiality of any personal or sensitive information obtained during the engagement.
8. Sick Day & Replacement Policy
As part of the weekly admin fee, Happy Hearts will coordinate a replacement Nanny for a prescribed number of Nanny sick days annually. Additional coverage requests may incur a supplementary fee and are subject to Nanny availability.
9. Dispute Resolution
Happy Hearts is available to provide support where necessary, but ultimate responsibility for resolving disputes between Clients and Nannies lies with the parties involved.
10. Amendments
We may update these Terms and Conditions as needed. Clients will be notified of any significant changes. Continued use of our services constitutes agreement with the latest version.
11. Governing Law
These Terms are governed by the relevant State laws of Australia. Any disputes shall be resolved under the jurisdiction of the relevant State courts.
